What "No Decree" and "With Decree" Mean

A "No Decree" package starts your case; a "With Decree" package carries it through the final decree that ends the marriage or sets the legal separation. The difference shows in the document lists above: the with-decree packages add the Acceptance of Service, Notice of Lodging, Consent Decree and/or Default Decree, and Property Settlement Agreement.

• No Decree — the opening papers: the petition, summons, preliminary injunction, required notices, and (with children) the parenting plan and child support worksheet, all filed with the court.
• With Decree — everything in the no-decree package plus the documents the judge signs to finish the case, whether your spouse agrees (consent decree) or does not respond (default decree).

Arizona courts cannot enter a decree of dissolution or legal separation until 60 days after the other spouse is served or accepts service, under A.R.S. § 25-329, so every with-decree case includes at least that waiting period.
