Key Takeaways

  • Arizona law (A.R.S. § 14-5315) requires every court-appointed guardian to submit a written report to the court annually.
  • The report is due on the date the court sets, and in no event later than 60 days after the anniversary of the date the permanent Letters of Appointment were issued (Arizona Rules of Probate Procedure, Rule 46).
  • The statute lists nine items the report must cover, including where the ward lives, how often the guardian visited, and a health professional's report.
  • Dynasty Legal Documents prepares and files the Annual Report of Guardian for a $350 flat fee.

What Is the Annual Report of Guardian in Arizona?

The Annual Report of Guardian is a written report that tells the court how the person under guardianship is doing. Under A.R.S. § 14-5315(A), a guardian must submit the report to the court annually, and also when the guardian resigns or is replaced and when the ward's disability ends.

The report is about the person, not the money. It covers the ward's residence, health and care. A conservator's financial report is a separate filing, covered on our conservatorship annual accounting page. If you have not been appointed yet, the first step is the court petition itself, which is covered on our Arizona guardianship document preparation page.

Ward
A person for whom a guardian has been appointed (A.R.S. § 14-5101).
Guardian
The adult the court has given legal authority to make personal decisions for the ward, such as decisions about health care and living arrangements.
Letters of Appointment
The document the court issues to show the guardian's authority. The date on the permanent letters is the date the yearly reporting deadline is measured from.

When Is the Annual Report of Guardian Due?

The report is due on the date your court sets. Rule 46(a) of the Arizona Rules of Probate Procedure adds an outer limit: the report may never be filed later than 60 days after the anniversary of the date the guardian's letters of permanent appointment were issued.

County forms often ask for it sooner. The Maricopa County Superior Court Annual Report of Guardian form tells guardians to file on or before the date listed in the court's order or, if no date is listed, on or before the anniversary date of the Letters of Appointment. A guardian who cannot file on time must file a motion for additional time before the deadline, stating why more time is needed and how much (Rule 46(c)).

What Must the Annual Report of Guardian Include?

A.R.S. § 14-5315(C) lists nine items every Annual Report of Guardian must include. Having them ready before your consultation is the fastest way to get the report finished.

What Happens If the Annual Report Is Late or Not Filed?

A missed report is treated as non-compliance. Rule 48 of the Arizona Rules of Probate Procedure allows the court to enter any appropriate order when a guardian fails to comply with the statutes, the court rules or a court order, including orders that:

  • Direct the guardian to comply by a date the court sets.
  • Require the guardian to appear and show cause.
  • Appoint an investigator to look into why the guardian did not comply.
  • Suspend or end the guardian's authority and appoint a successor or temporary guardian.

The same rule allows the court to begin proceedings that may lead to a fiduciary arrest warrant under A.R.S. § 14-5701. Each county handles the first steps its own way. Pinal County Superior Court, for example, states that it sends a non-compliance notice listing what is missing and a new due date.

Annual Report of Guardian vs. Conservator's Annual Accounting

A guardian reports on the person, and a conservator accounts for the money. They are two separate yearly filings, and a person appointed as both guardian and conservator has both duties.

Adult and Minor Guardianships in Maricopa County

Maricopa County Superior Court's Annual Report of Guardian form states that it applies to every guardian of a protected or incapacitated adult or minor in a probate case, meaning a case number that begins with "PB." Cases with numbers that begin with "JG" or "JD" are Juvenile Court cases and use a separate Annual Report of Guardian packet.

A guardian who holds inpatient psychiatric treatment authority and wants that authority to continue has an additional filing: a new evaluation report from a psychiatrist or psychologist, due no later than 30 days before the authority terminates (Ariz. R. Prob. P. 47).

When you should talk to an attorney instead

A certified legal document preparer prepares and files the report at your direction. Consider a licensed Arizona attorney if:

  • Someone has objected to your report, asked the court to remove you as guardian, or filed a petition about contact with the ward.
  • The court has set an order to show cause or a compliance hearing and you want someone to speak for you in court.
  • You want advice on whether the guardianship should continue, be limited or end.
  • Family members disagree about the ward's care or where the ward should live.

Dynasty maintains a referral network of Arizona attorneys and will tell you at the consultation if your matter is one to refer out. The State Bar of Arizona also publishes resources for finding a lawyer.

NOTICE: We cannot work with individuals that are currently working with an attorney.

Frequently Asked Questions About the Annual Report of Guardian

Are annual guardian reports required in Arizona?

Yes. A.R.S. § 14-5315(A) requires a guardian to submit a written report to the court annually, and again on resignation or substitution as guardian and when the ward's disability ends. The report is filed with the superior court that made the appointment.

When is the Annual Report of Guardian due in Arizona?

The report is due on the date the court sets. Rule 46(a) of the Arizona Rules of Probate Procedure adds that it may never be filed later than 60 days after the anniversary of the date the guardian's letters of permanent appointment were issued. Maricopa County's form asks for the report on or before the date in the court's order or, if no date is listed, on or before the anniversary of the Letters of Appointment.

What is an annual account for guardianship?

An annual account is the conservator's yearly financial report, not the guardian's. A guardian files the Annual Report of Guardian about the ward's residence, health and care under A.R.S. § 14-5315. A conservator files an annual account of income, expenses and assets under A.R.S. § 14-5419. A person appointed to both roles has both filings.

Is there a filing fee for the Annual Report of Guardian?

It depends on the county. Pinal County Superior Court states that there is no filing fee for the annual report. Court fees are set county by county and they change, so confirm with the clerk of the court that appointed you. Dynasty's $350 flat fee covers preparing and filing the report and does not include any court fee.

Can I file my Arizona Annual Report of Guardian online?

Filing methods differ by county. Maricopa County Superior Court's instructions describe filing the report by mail or in person with the Clerk of the Superior Court. Check with the clerk of the court that appointed you for the methods it accepts. When Dynasty prepares your report, filing with the appropriate Arizona court is included.

Do I need a lawyer to file the Annual Report of Guardian?

Superior courts publish the Annual Report of Guardian form and instructions for guardians who file on their own. A guardian can also have a certified legal document preparer prepare and file the report, or hire an attorney. A document preparer cannot give legal advice, so if someone is contesting the guardianship or the court has set a hearing, talk to a licensed Arizona attorney.

How much does it cost to have an Annual Report of Guardian prepared?

Dynasty Legal Documents charges a $350 flat fee to prepare and file an Annual Report of Guardian. The fee includes guidance on completing all required forms, review of the report for accuracy and completeness, filing with the appropriate Arizona court, and support for questions about the process.

What happens if I miss the deadline for my guardian report?

Rule 46(c) requires a motion for additional time to be filed before the deadline. Once a deadline is missed, Rule 48 allows the court to order the guardian to comply by a new date, set an order to show cause hearing, appoint an investigator, or suspend or remove the guardian.
